Terms of Use

1. Who can use Pozelle

Pozelle is not intended for children. The minimum age is 13 in the United States and 16 in the European Union and the United Kingdom, or higher if the law in your country requires it. We delete data that we learn was collected from someone below the minimum age. If you use Pozelle on behalf of someone else, you confirm that you are authorized to do so.

2. What Pozelle does

Pozelle offers effects (light, colors, camera look) that apply to your photo, and templates that create a new scene with you in it. To create the image, the photo you choose is sent securely, through our server, to our AI image-generation providers, including Google models. We do not keep your photo, your result or your request on our servers beyond processing. Your creation history stays on your phone. Images created are AI-generated and may be labeled as such where the law requires.

3. Your content and your rights

• You remain the owner of your photos. You are free to use the images you create, but their legal status varies by country: an AI-generated image is not necessarily protected by copyright, and we do not guarantee that it is free of third-party rights.
• You grant us a limited, revocable license to process your photos solely to operate Pozelle (sending them to our providers, then returning the result to you).
• You must have the right to use every photo you upload, including the consent of the people who appear in it.
• Prohibited: images of minors without verifiable consent from a parent or guardian, any sexualized content involving minors, nudity, deepfakes made without consent, harassment, hate, and any content that is illegal or infringes the rights of others.
• You are solely responsible for the photos you upload and the images you create. To the extent permitted by law, you will indemnify us against third-party claims arising from your misuse of Pozelle.
• We may block or refuse any content or access at our discretion.

4. Acceptable use

You agree not to bypass technical limits, daily creation limits or subscription limits; not to probe the service for vulnerabilities or circumvent its protections; not to disrupt the service or its providers; and not to use Pozelle for unlawful or defamatory purposes or in a way that violates the privacy or image rights of others. We may monitor for abuse, apply automated or manual moderation, and suspend or close access.

5. Subscriptions, creations and payment

• AI features use creations, available through auto-renewing weekly subscriptions and through creation packs purchased through Apple’s App Store, managed with RevenueCat. One effect or one template = one creation.
• Plus: €7.99 per week, 5 creations per day. Gold: €12.99 per week, 10 creations per day. There is no annual plan. Prices vary by country and currency; Apple shows the exact price before purchase.
• Free trial. A 3-day free trial may be offered to you. If you do not cancel at least 24 hours before the trial ends, the weekly subscription starts automatically at the price shown.
• Daily creations. They renew in full every 24 hours, starting from the time of your subscription. They do not accumulate and are not carried over.
• Creation packs (subscribers only, for example 10, 25 or 60): one-time purchases added to a separate balance that is not reset every day. They are non-refundable once used.
• Billing, renewal and cancellation are handled by Apple: Settings › [your name] › Subscriptions. If you cancel, access continues until the end of the paid period.
• Refunds. We do not refund directly; Apple handles requests under its policy and the consumer rights of your country.
• We may change prices for future periods; Apple shows you the new price before renewal and you may cancel before it takes effect. Taxes may apply.

6. Entitlement checks and limits

To verify your subscription, manage your creations and enforce daily limits, we validate transaction data signed by Apple through RevenueCat and our server. We may also use an anonymous identifier generated by the app, network metadata to prevent abuse.

7. Third-party services

Pozelle relies on Apple (StoreKit) for payments, RevenueCat for subscription management, our server host, and AI image-generation providers (including Google models). Each has its own terms and privacy policy; we are not responsible for third-party services.

8. Apple-specific terms

These terms are between you and us, not Apple. Apple is not responsible for Pozelle or for generated images, and has no obligation to provide maintenance or support. If the app fails to conform to an applicable warranty, you may notify Apple to receive a refund of the purchase price. You must comply with Apple’s usage rules. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.

9. Intellectual property

Pozelle (software, logo, templates, brand) belongs to Pozelle or its licensors. You have a personal, limited, non-transferable license to use it on your Apple devices. Copying, decompiling, modifying or reselling the app is prohibited. To report a copyright infringement, write to us with the work concerned, the infringing content, your contact details and a good-faith statement; we may remove content or close access in case of repeated infringement.

10. Disclaimers and limitation of liability

AI can make mistakes: results may not meet your expectations. Pozelle is provided “as is”, to the extent permitted by law. We are not liable for indirect damages. Our liability is limited to the greater of the amount you paid over the last 12 months or €100. Nothing in these terms limits liability that cannot be limited by law, or your mandatory consumer rights.

11. Ending your use

You can stop using Pozelle at any time and cancel your subscription with Apple. We may suspend or close your access in case of violation, risk of harm or for legal reasons.

12. Governing law and disputes

These terms are governed by French law, without depriving a consumer of the mandatory protection of their country of residence. Before any dispute, write to us. You may also use a free consumer mediator: CM2C, Centre de la Médiation de la Consommation de Conciliateurs de Justice, 49 rue de Ponthieu, 75008 Paris, https://www.cm2c.net, declarer-un-litige@cm2c.net. Export and sanctions compliance: you do not use Pozelle in a sanctioned country or if you are a sanctioned person.

13. Changes and contact

We may update these terms; in case of a material change, we will tell you in the app or on the App Store listing. Continuing to use Pozelle means you accept them. Questions?
